The appellate court’s decision to maintain the dismissal is a crucial victory for organized plastic surgery. The victory also serves a reaffirmation of the ‘Do Your Homework’ public awareness campaign led by the ASPS to improve patient safety.

The campaign had encouraged people to choose an appropriately qualified plastic surgeon for their needs, and not go for surgeons who may not actually have the requisite qualifications or skills. The Appeals Court decided that the defendants had not indulged in any deceptive advertising, and confirmed the previous ruling.
